Penalty for gap in health care coverage
« on: May 28, 2015, 08:31:59 AM »
I am waiting to receive an official job offer at some point today.  They indicated that they want to make me an offer and are very interested, so hopefully the official document will come in the next couple hours (via email).  I expect for the final numbers to be very reasonable and if so, I will accept.

Anyway, assuming thigs will go as planned, my health insurance coverage may have a small gap in it, approximately 2 weeks.

Right now we are covered under H's old plan which ends May 31st.
If I accept new job offer, I expect to start there on June 15th and will be eligible for coverage right away.
For the 15 day gap I have two options:
1. Leave it as a 2 week gap.
2. Sign up for a coverage with my current employer (losing H's old coverage is qualifying event, so I can do that).

My concern is that I will have to sign up for health coverage and give my two weeks notice on the same day. I'm sure they will be 'thrilled' about that.  Is it worth it to the hassle for two weeks?  Should I just go with the 2 week gap?  We have two kids, ages 10 and 12.  I have visions of something horrible happening all of a sudden.  On the other hand my HR said I can sign up later in the month of June (this was before the new job was on the horizon) and elect coverage starting June 1st.

Also, I found this regarding tax penalties for gap in medical coverage https://www.healthcare.gov/exemptions-tool/#/results/2014/details/short-gap
But it only talks about 2014 of no penalty for gap less than 2 months.  How likely is it to go away for 2015 tax year and I would own extra taxes due to this 2 week gap?

What would you do in my situation?

Will your H qualify for cobra? If so, you have a 60 day period to signup which if elected would be retroactive to the qualifying event. This is how I handled a month gap last year. Had I had a big medical expense, I planned to retroactively start COBRA.

Who gives a shit about how thrilled they are. Until you're fired or your last day comes around your benefits as an employee are your benefits. That's how I would handle it initially.

If your company cans you for giving your two weeks then you can worry about taxes then. But more importantly it's two weeks, depending on how risky of a lifestyle you and your husband lead then screw it, I'm sure the tax penalty is nil to nothing. Probably less than a months premium.

Oh, I forgot about COBRA.  Yes, he will qualify for COBRA.  Thank you for mentioning it.  Completely forgot about that option.

It would be much more expensive that my current employer coverage if, god forbit, we have to use it.  But chances of that happening in two weeks are slim.

Now I feel silly for posting this in the first place.

They won't fire me for giving notice.  But it's a hassle to go through enrolment process.  rtrnow reminded me about COBRA, which I completely forgot about.  That may be the best route if I am definitely going to give them notice on tomorrow or Monday.  Otherwise, if I'm staying, I'll just enroll for the long haul until I find another option/job offer.

I'm pretty sure this did not change for 2015.

You're fine. There's an exemption if the gap is less than 2 months.
