House V. Burwell GOP assault suit on ACA CSRs
« on: May 08, 2016, 11:31:12 AM »
"HOUSE v. Burwell, on the other hand, threatens to kill CSR (Cost Sharing Reduction) subsidies for around 57% of those enrolled in ACA exchange policies living in every state (likely around 7.3 million people this year). That's the number of people who a) have incomes below 250% of the Federal Poverty Line and b) chose Silver exchange policies."

The suit will kill the funding for cost sharing reductions.  However the law still declares the must exist.  The Silver plans prices will have to rise to adjust.  The article explains the convoluted results and unexpected winners and losers of this case.

A follow up.  5/12/2016

"A federal judge ruled for House Republicans on Thursday in their suit against President Obama and declared his administration is unconstitutionally spending money to reimburse health insurers without obtaining an appropriation from Congress.

The judge's ruling, though a setback for the administration, was put on hold immediately and stands a good chance of being overturned on appeal."
