What is the deadline for filing Form 5500EZ? Confused.
« on: June 04, 2020, 11:07:22 AM »
Hello. I’m getting conflicting information about the deadline for filing Form 5500EZ. Unfortunately, my CPA doesn’t handle this form and can’t offer me advice. I probably will call the IRS Helpline but wanted to know if I was missing something before calling them. I don’t know what I don’t know and had relied on Vanguard to provide me the correct information.

Here are the details:

- Business was an LLC (pass through) and the last year of income was 2018. Last Schedule C was filed on 2018 taxes.
- Plan was i401k, single participant (me).
- In April 2019, I rolled the assets into a traditional IRA. The i401k balance was always under the $250K threshold during the entire time the plan was in existence.
- The rollover was reported on my 1040 for the 2019 tax year.

What is the deadline for filing Form 5500EZ?

1)  Seven months after the rollover in April 2019? If yes, I'm late and can I apply for the penalty relief (5500EZ Box D)?

2) July 31, 2020, like Vanguard says? If yes, do I check Box B for the extension and report a short plan year of 01/01/2019 - 04/08/2019?

Thank you.

For a short plan year, file a return by the last day of the 7th month following the end of the short plan year.

My interpretation:

It's not 7 months after the rollover, it's 7 months after the end of the short plan year. In other words, 7 months after the year in which the short plan occurs.

You'll also need to check box I.A.3 for "final return."

There is no extension. It's due on 7/31/2020 for 2019 plans.

Wow, a phone plan for fifteen bucks!
