Your ideas about a fair solution

Hi MMM Friends,

I'd like to get your thoughts about solutions in the scenario where there's water from my unit that drips to the unit below and causes discoloration on the ceiling in the unit below (or if the unit above mine has water leakage and causes discoloration to my ceilings or walls).  These are condo units.  Should the unit that caused the water leakage pay for the paint and work to repaint the areas that have been discolored?

Depends.  These are condos, so what is the association responsible for?  In some, the association is responsible for everything in the walls.  If the leaking pipe/whatever is in the wall, it might be the association's problem to fix.  Check CC&Rs, and property management.

If not, then yes, it's your responsibility to fix, obviously.  If something from your property damages someone else's, then that's on you.

Thanks for your feedback, iamlindoro and Beardog.  This would be a situation where the pipes are in the walls but within my unit.  I'll take a look at the by-laws and check with the mgt company.  Thanks again!

Definitely check the hoa regs. In my last condo, the upper unit owner was responsible for damage done to the lower unit but it varies.

Hopefully the HOA owns the pipes and therefore any damaged caused by them.

If not, then the owner of the unit that caused the leak is responsible for damages resulting from that leak.  Depending on the extent of the damages, it might be worth going through your homeowner's insurance, but if it is just small water spotting or drywall damage, it's probably not worth it.
