Tax law and investment professionals agree it's complicated and very grey. That article is highly misleading and overblown, though there could eventually be some small truth to it, my guess is that it will never amount of anything. And at this point guesses are the best we have, if the IRS ever takes it up we might find out if there is any real problem. But if they don't then it will just hang out there with no resolution.
