Anyone Here Consult With Open Source Software?
« on: May 20, 2021, 09:45:10 AM »
I am curious: does anyone here have a consulting business where they use open source technologies like Python, R, etc. in their work with client data?

I have been thinking about starting a consulting business after school but not sure how to protect myself from liability when using these platforms. Is this something that can be insured away? Or would you need to simply get liability exemption in Service Agreement?

In this same vein, I have had trouble finding good legal advice for getting service agreements setup etc where the lawyer has a decent understanding of the legal landscape as it relates to technology and data. Any resources to get this help at a small business price that anyone is aware of?

I've never heard of liability for common, well known, software frameworks. As long as you don't plan to use some obscure language like, say, Miranda*, there shouldn't be an issue. I always pulled in what I needed as far as packages, as well.

I worked a few 1099 gigs with a consulting company and then ripped off used their service agreements as an example. Often, the client would supply their own agreement and I would just change it as needed. No client ever denied a reasonable change re: deadlines, response times, vacation coverage, etc.

Add in an LLC and some decent E&O and you're good.

E&O / professional liability coverage and a contract that limits your liability is almost certainly all you need to get started. Hiscox will sell you the former and Obie Fernandez will set you up with the latter.
