Working 2 full time jobs at the same time?
« on: July 19, 2020, 11:45:41 AM »
Hi fellow mustachians.

I have been working for the same company for over 4 years and I feel I'm being undervalued (and of course underpaid)
So I went ahead and looked for some new opportunities. I have to say I'm a software engineer.
I got an offer from a new company with a 30% salary increase over my current job.

My current job is supposed to keep me busy 40 hours a week but I can definitely do it in way less time than that.
I also feel the new job can be done in less than 40 hours a week.
So I'm thinking about working both jobs at the same time.

I went through my first job offer letter and it doesn't say it does not allow me to work somewhere else.
About the new offer letter, it states: "...I further certify that I am not subject to any employment contract, non-compete agreement, non-solicitation agreement or other similar restrictions or agreements..." - So I believe the new job doesn't want me to do other work.

But here is where I was thinking, can I just accept the new job along with the old one and in worst case scenario, if they find out they will terminate me, but I don't see this as a down side since I will keep my old job.

I want to know what do you guys/gals think about this situation, what would you do if you were in my shoes.
I have no debt but working 2 jobs basically doubles my income and cuts my retirement date in half (more or less)

Thanks

tawyer

Are you in an "employment at will" state? I am, although the "subject to any employment contract" is the only part that makes me hesitate, I don't interpret it as you do. Are the two companies in the same industry?

I've always wanted to do this, at least for the first month of a new job, because you never really know what you are getting in to. Ultimately, the stress of managing two calendars has put me off. What can you do/say when both of your bosses schedule a meeting at the same time? And then when it happens again? And again?

Yes I am

I am, although the "subject to any employment contract" is the only part that makes me hesitate, I don't interpret it as you do. Are the two companies in the same industry?

What I understand by that is that I cannot have any other contract, so I would not be allowed to have other job.
The companies are in very different industries.

What can you do/say when both of your bosses schedule a meeting at the same time? And then when it happens again? And again?

I have the freedom to move meetings around in my current company. My schedule is supposed to be flexible so I could be working 2pm - 10pm if I wanted to.

Here is the key parts of this contract/offer letter:
Quote
At-Will Employment
This letter should not be construed as a contract of employment for a fixed period of time.  Other than as expressly stated herein, your employment is “at will”.  XXXX reserves the right to terminate your employment at any time for any reason without any severance obligation (other than as required under the paragraph entitled “Salary Continuation”). Likewise, you are free to terminate your employment with XXXX at any time.  This letter supersedes all prior agreements, proposals, understandings, negotiations and undertakings, whether written or oral.  This agreement may not be modified or amended except in writing by the CEO; no employee of XXXXX is authorized to make oral promises and/or changes to these terms.

Appendix
I, XXXX confirm that I have abided by any and all policies, directives, requirements and restrictions on the part of my current and previous employers concerning possession and use of proprietary information or property and that I will not use any such information or property in connection with my employment with XXXXX (“XXXX”) in violation of any such policies, directives, requirements or restrictions.  In addition, I acknowledge that any breach of these directives, policies, requirements and restrictions could result in my termination from XXXX, and any civil or criminal charges and convictions that might result therefrom subsequent to my employment with XXXXX are entirely my responsibility. I further certify that I am not subject to any employment contract, non-compete agreement, non-solicitation agreement or other similar restrictions or agreements, except as disclosed in writing to XXXX's CEO prior to the date of execution and delivery of this letter.

Unless it gets you into a pickle with both and there's a chance you're out on your ass with 0, why not? Many people date too many and end up with zero for awhile, so it's a thing. That's basically what I do but without the complications of employer jealousy--a number of years I cancelled nights and weekends and more than doubled my income, which blasts things out quick fast in a hurry.

Look, whether you technically can do it, it's unethical and shady as hell. You've got pretty good odds of being fired from both jobs if you're found out, and good luck on the reputation side.

You're being paid to work full time. Pick a job and do so. If you want to have a side job, that's fine, but you can't do it at the same time you're supposed to be working at your main job.
