teacher liability insurance
« on: August 18, 2015, 11:53:39 AM »
Any teachers have liability insurance? If so, where through and how much coverage? My wife is a new teacher and was approached about an educator group that provided $1mil coverage (And some small other benefits) for $179 a year. Thoughts?

Also, she is a special ed teacher. I am not sure if it matters but I could see it being a bit more litigious.

My wife is a teacher, and I have never heard of this.

My wife is also a special ed teacher.
Her union should already have her covered to a certain amount but I suggest you two research it first.

She decided that her union was not representing her as she saw fit and left it. There was some other organization providing that coverage and some other benefits which she joined, probably a similar thing. I couldn't tell you about the specifics but I recommend her having some sort of insurance.
A friend of ours went through hell at the end of her first year and was close to lawsuit territory. Remember, the district and school are looking out for the district and school, the teacher may need to have his/her own coverage.

I imagine anything that this teacher policy would cover would also be included in a personal umbrella policy (which would cover MUCH more in addition for about the same price)

My wife is an elementary teacher in a public school district.  Back when our kids were minors and driving we had an umbrella policy and because of her profession the premiums were higher.
She thought it was silly and had never heard of anyone in her district needing this type of insurance.  We only carried it to protect our assets while we had to answer for any mayhem the kids caused (thankfully none).

Do you have a local lawyer friend you could ask?  I have a lawyer friend that sued a public entity/employee (not sure if it was personally or not) but I remember him talking about the fact that they had insurance actually increased their liability somehow.  Probably varies greatly by state.

This is just professional liability that probably has some kind of special clause that makes it look like it is directed at teachers. The special ed part of this is what gives me pause. I have heard of teachers being injured by special ed children, but not the other way around. I  imagine it does happen from time to time, but the school should be covered as an entity for this. So it would be an excess policy above their limit, or if the reason for the injury was outside of the school's coverage. The only ways that should happen is if there is a contract stating that the union / teacher is responsible for coverage (like a 1099 employee), or if the teacher did something absurdly egregious that it couldn't be justified.

I have liability insurance and it is like 140/year.  there are many reasons teachers might get sued, and especially for sped teachers, I would get insurance.

As W2 employees, shouldn't teachers have any job-related liability redirected to the employing entity?
