Paternity Leave Canada

Met with my boss a few days ago and mentioned I wanted to take a month off starting around the middle of march.  I put in a lot of hours over the last few months and I'm burnt out at work and at home.  And rather then do something drastic I think its best i just take some time and reset.  Im not worried about taking the month off financially that won't be a problem, so I told my boss Whatever is easier for him I can take a LOA without pay or I can go on holidays (but I don't have enough holidays)  or I can just take my paternity leave.

He immediately interrupted me and said "why would you take paternity leave"  "you don't need to take paternity leave" just take your holidays.  I explained to him that If I take my holidays I don't have enough time off to cover so some of it would be a LOA, also in the summer I am still going to want to take holidays... So I don't want to use them all up in march then be told to bad so sad come summer.

I am confused why he was SO against Paternity leave...  Either way I'm leaving the country so LOA or Holidays or Paternity Leave there is no way I can cover for a day or two here and there if that is what he is thinking?  I'm hopping on a plane and going somewhere hot for the month...

If I take paternity the company HAS to reward me a similar job with atleast the same pay or greater, so maybe there are other benefits of taking Paternity leave?  Would I be smart to take paternity leave regardless of his opinion?  I can just tell him I need paternity leave for the money and tell him I'm broke...

FYI - Off topic but my wife is also on paternity leave so between the two of us we get so much money annually, so If take some of that money now, she will end up with no pay for the last month of paternity leave...  So I don't really care if i get that money now or at the end... and I don't need the money.

Parental, is the word you are looking for. The mother gets maternity for 17 weeks, then there is another 35 weeks of parental available which can be split anyhow between the two parents.

You can legally take the time. You can take your boss to court if they refuse; but of course then your work life would be screwed. I mean, I wouldn't stand for a company refusing legally provisioned stuff; I would choose not to work there. But that's your call regarding availability of work. You'd just have to be very very careful going forward; documenting everything. Not ideal.

If your work is at all precarious or unhappy about this leave take parental leave - it's a protected leave so you can't be fired for taking it and your working conditions can't be changed as retribution for taking it. You'll get 2 weeks of EI, which is slightly better than nothing. If you take a regular unpaid leave they don't have to hold your job for you and can demote or otherwise punish you for your absence.
