Author Topic: Filing Federal Return Jointly and State Return Separately Allowed?  (Read 1968 times)

First Tax Year as a married guy, so I ran our taxes both ways and we get more money back jointly from the feds but we owe $$$ to the state filing a joint return vs getting several hundred back from the state when filing separately.  So it was considerably better to file separately.  But ideally we could file jointly for the federal return and separately for the state returns.  A coworker of mine said this is what turbo tax suggested.  However, a quick google lead me to sights that say it is not allowed if you and your spouse live together and have income in the same state.

But I haven't seen anything real official. 

I guess I could just do it, the free efile software I used doesn't allow it but I could just do multiple accounts one for jointly and one for each of us for state.  So the extra time messing around on the e file site would be worth it, but I'm not sure it is if I'm doing something illegal, though I doubt the risk of audit would be much.

We're in AR by the way.

Found this on the Arkansas state web site: http://www.dfa.arkansas.gov/offices/incomeTax/individual/Documents/103-WhichFilingStatus.pdf "If you file a joint federal tax return you are not required to file a joint state tax return."

Keep in mind many cheap/free e-file services may not allow you to file a state return by itself.

Good to know, I always frequent this one and investor alley but should have checked to see about a tax sub-section
