Recommend a MMM will?
« on: February 21, 2014, 11:03:15 AM »
One of my to-do items is write up a will.  Don't want to spend a lot of money but not sure how to make it legit and cheap at the same time.  What are your recommendations?

I have the same question!  Would really love to hear people's answers.   I don't want to pay for a trust, but I'd like to say "here's all my accounts, whatever the number is when I die, split the income between these 20 people and organizations."

It really depends upon what you want to do, but I'd definitely check and see what your state's Probate law is. Estates of people who die without a will go to probate, and if you're ok with what probate will do, you don't need a will.

I used Rocket Lawyer. http://www.rocketlawyer.com/legal-documents-forms.rl They make you sign up, so they can try to sell you additional services, but it was free and easy.

I used LegalZoom for a revocable living trust doc.
Had an attorney do a quick review, got it signed and notarized and good to go.

Many bank and investment accounts have a Payable on Death designation that lets you specify the beneficiaries. Your beneficiaries could then access your assets with just a death certificate, their IDs and your account info, no will required. And if it's a jointly held account, the other individual already has access to the funds, no paperwork required whatsoever. An informal sheet of paper explaining all the account information and who you have designated beneficiary on each account would just help them out. It does get more complicated with real property.

That said, you probably should look into a will with a pour-over trust if you have any real property. If you aren't making any crazy distributions (you're just giving cash or ownership straight up to whoever is still alive) and are pretty trusting of your survivors not to quarrel, just a basic setup should be enough. If no one is going to challenge what you say, then all you need is enough for your designated heir to be able to transfer the assets into their name.

And, it should go without saying that this is not legal advice, see a real attorney before making any decisions.

If it's not complicated, I agree you can just use a form for your state.

Enough with the legalese. I think a MMM will needs, above all, to be pretty funny. I mean, you have all this capital, you've read enough so you don't want to leave it to your kids, what better use than to have a hilarious and nourishing death? I picked those adjectives semi-randomly, so please feel free to riff on the theme.

I'd like to see that your will specify a cartoon theme, of your choosing, for the funeral. Maybe you place a costume-requirement on the proceedings, fantastic! The specifics are up to you, get creative! If you want to celebrate your death at a higher level, specify a ridiculous pose that your corpse could be frozen in. Maybe consider animatronics?

How can a will help the future generations enjoy a tasty treat? Demand burial in a cardboard (or otherwise biodegradable) box, underneath a tree the whole family can enjoy! Consider a tasteful sign to be planted, informing bypassers they can bite into a wholesome Kriegsspiel apple! Or a dragoncar fig?! Let your imaginations run wild!

+1  This would be awesome.

Breathalyzer required at funeral.  0.08 and below turned away at the door.

The winner of a "Hands on the Hardwood (Casket)" endurance competition takes the entire estate. But the breathalyzer thing is a requirement to compete.

From the direction this conversation has gone, I can only assume some of you all have been starting the party already and having wine.
