Legal Fee deduction

I am suing my former employer for Disability Discrimination and Hostile Work Environment under the Rehabilitation Act and Title 20.  I understand that I am able to get a deduction for my legal fees, but cannot distinguish if it something that can be taken off my AGI or has to be claimed under the itemized 2% misc. deduction.  Thanks in advance for your assistance.

Do you have a CPA you use and how are you paying your legal fees? Are you paying as you go or will they be taken out of your settlement? From this it seems like you could deduct them from your AGI if they are taken out of your settlement. However the details of your case may be different than those of this case.

 - Find a CPA who has experience in dealing with this type of case. If you need help finding one you can contact either the AICPA or your state's association of CPA's
