Leaving CA, tax questions
« on: April 25, 2016, 09:24:27 AM »
A few months ago, I moved out of CA to a no income tax state (NV) for a new full time job. The job has been a huge flop and I have already put in my notice (stumbled into some really bad stuff going on there, need to get out ASAP).
The only other position I can find right now is a part time job with 24 hrs/week. However, I have the option of picking up extra per diem work back in CA, with another company, to help supplement the part time income.
My concern is that this will throw off establishing NV as my domicile since I just moved at the end of Feb. I've heard of CA looking for any ties back to them and claiming you're still a resident, thus taxing you on all earned income.
Does anyone have any experience with this? Any help would be appreciated, thanks!

If you're earning money in CA, regardless of whether you live in NV or any other state, CA will want you to pay tax on the CA income. It makes your taxes more complicated to live in one state and earn in another, or to move between states during the year. But you won't get double taxed on the income (even if NV did have an income tax).

Yes.  You would file as a non-resident of CA and apportion the income from CA (taxable to CA).  You should be able to find the information and instructions for filing at the California Tax authority web-site.  You pay CA income tax on the income earned in CA and NV income tax (none) on the amount earned in NV.  Your mailing address, voter registration and usually drivers license is proof of residency.

You should check with the CA taxing authority.

Similar to those who live in one state but earn rental income in another.

I live in CA and work in NV. I assume you rent in NV, do you own a home in CA? If not, I think you are good. What kind of work is it that you are doing?

Thanks for everyone's input! Ya I was renting a home in CA before moving in Feb, now I'm just renting a place again here in NV. I've registered my car and gotten a nv license as well.
I'm a pharmacist and am getting on board with a temp agency on top of my new part time job. I'll have plenty of opportunities to pick up extra shifts in CA, but I don't want this to trigger any type of residency audit from the ftb or anything. I'm sure once I'm classified as a non-resident by CA I'd be able to pick up shifts there without issue, I'd just be taxed on my income there. I'm just concerned picking up shifts might result in me not being classified as non resident since I just left

You will have been in NV more than 6 months when you file your 2016 taxes. You don't need to worry, you'll be a Nevadan by then!

But like the other posters mentioned, you'll need to file a non-resident state tax form with CA. I do that every year for my rental that is in another state. No big deal.

Wow, a phone plan for fifteen bucks!
