Questions to use to screen a wrongful death attorney
« on: April 20, 2023, 12:36:22 PM »
I have to hire a wrongful death attorney. What advice do y'all have?

Here are some questions I'll ask when interviewing them. I'll make a spreadsheet with their answers.
a.   Name of Firm
b.   Name of assigned attorney
c.   What is the contingency fee
d.   Is the contingency fee different if they we don’t settle but go to court? What if the other party doesn’t show?
e.   Where is their physical office is located
f.   Track record (similar cases they have handled)
g.   Their opinion of the insurance claim, civil claim against x, civil claim against y
h.   How often will we be in contact with our attorney?

What other questions would you suggest? Do you have any other advice or considerations I should keep in mind?

I'm sorry for your loss.

There are probably actual attorneys on this forum that can do a better job of answering this question. However, I don't see any responses yet, so I will be the first.

The firm is most profitable when it gets an average settlement in a short amount of time. Time is money. It's not worth it to them to spend another 20% of time on a case to try to get an increase of 10% in the settlement. It's kind of like hiring a real estate agent to sell your house. If you are selling a house for 300K and get offered 280K in the first week, most real estate agents would tell you to take the money, even statistically speaking, you are more likely to get 290K if you keep it on the market for another 30 days.

To serve yourself best, it's typically best to drag it out a little longer than your agent wants, so you can get top dollar.

Former attorney here. Very sorry for your loss.

A good attorney is also a good salesperson. A good salesperson will just tell you what you want to hear. If the attorney doesn't answer your questions well, they might still be a good attorney, even if they're not a good salesperson.

Word of mouth is the best way to find an attorney who will care about your case as if it were their own. Is there anyone in your network with legal connections?

(A good attorney will know the difference between a wrongful death action and a survival action, which might matter in your jurisdiction.)

Sorry for your loss!

I have started watching a lot of "law tube" (lawyers on Youtube who do analysis of major cases) and one of the bigger channels I watch is called The Lawyer You Know and run by a guy (Peter Tragos) who specializes in this kind of thing.  He is in Florida but their firm practices in several states and he has contacts all over the country and seems to be pretty helpful about making recommendations for good attorneys in his network.  Might be worth contacting him.  He might have some videos on his channel about how to vet attorneys, too.

It looks like they only have one very short video specifically about wrongful death issues, but they do have quite a long playlist on general personal injury questions:

FWIW I used to have a pretty negative view of personal injury attorneys (having had to defend myself against one who really was NOT a good one), but this guy has turned my view around. Hopezz you can find somebody good for your case.
