Anyone us online app "Willing" to do a Will?
« on: February 18, 2020, 08:38:07 AM »
My brother is dying and has no will.

He has no current assets that would need to go through probate (underwater on car lease, will let it get repossesed, rents an apartment, has $5 in his checking account and has named me as the beneficiary for his tiny IRA account which will be enough to pay for burial expenses.) He is married and his children are adults. No life insurance. Has always lived paycheck to paycheck.

He is entitled, however, to his share of our parents' estate (both parents are deceased, we are going through probate now) which will be approximately $75,000. His wishes are to divide the inheritance evenly (33 1/2 %) between his wife and two adult children.

He is currently in a hospital and may never leave there.

Would an attorney go to a hospital to do a will?

I see on Groupon that I could use an online template Willing.

I would have to get a notary to go to the hospital to notarize his signature and I could get family members to be witnesses. Does anyone have any experience with that?

I hate that I know the answer to this question.  :(  But, yes, an attorney will come to a hospital and do a will.  In my mom's case, I needed power of attorney and a will and a couple other documents and he asked me beforehand how my mom wanted it written up.  She was of sound mind, so she was able to sign off on the will, otherwise, I'm not sure what could have been done.  I want to say my attorney charged me about $500 for that.  Your brother's will may be a tad bit more complicated because he hasn't received the inheritance yet.  I'm sure others will have more complete answers for you.  For me, the scariest part was just calling a lawyer and trying to understand all of the steps that needed to happen.  Once I got over that fear, the rest was pretty easy.  Good luck to you, I know that's a difficult situation to be in.

Oh, and as far as witnesses, I had one aunt and one uncle come to the hospital as witnesses, they had to provide their driver's licenses and sign the documents.  It took maybe 30 min for the lawyer to go over the paperwork with my mom to make sure she understood and agreed to it.

I'm an estate planning attorney, and I have visited clients in the hospital to sign their documents.  Not often, and in most cases I insist on speaking directly with the client--I won't take direction from a family member, who could then be accused of undue influence--but I've done it.

Wow, a phone plan for fifteen bucks!
